Family-based immigration cases involve U.S. citizens or lawful permanent residents (LPRs) sponsoring certain family members for green cards (permanent residency). There are two main categories:
1. Immediate Relatives (Unlimited visas available)
- Spouse of a U.S. citizen
- Unmarried children (under 21) of a U.S. citizen
- Parents of a U.S. citizen (if the sponsor is 21 or older)
2. Family Preference Categories (Limited visas available each year)
- F1 – Unmarried adult children (21+) of U.S. citizens
- F2A – Spouses and unmarried children (under 21) of LPRs
- F2B – Unmarried adult children (21+) of LPRs
- F3 – Married children of U.S. citizens
- F4 – Siblings of U.S. citizens (if the sponsor is 21 or older)
The process for citizenship is long, but in general it follows this process:
- File Form I-130 (Petition for Alien Relative) – Establishes the relationship
- Wait for Visa Availability (if applicable) – Immediate relatives skip this step
- Consular Processing (Outside U.S.) or Adjustment of Status (Inside U.S.)
- Consular Processing: The applicant applies at a U.S. embassy/consulate
- Adjustment of Status (Form I-485): If the beneficiary is already in the U.S. on a valid visa
- Attend Interview & Medical Exam
- Receive Green Card (Permanent Resident Status)
