Defendant, the project developer, hired The Kaufman Company as the general contractor. Kaufman, in turn, hired S&S Concrete as a subcontractor, which then hired Nahum Rios Construction as a lower-tier subcontractor. Our client was hired by Nahum Rios Construction to perform cement finishing work on sidewalks and driveways. Plaintiff was working on a new residential construction project in Plano, Texas, performing concrete work for Nahum Rios Construction on behalf of Defendant.

During the course of his work, Plaintiff was struck in the head by a concrete pump truck hose that suddenly whipped, causing him to lose consciousness. After the impact, a significant amount of wet concrete was discharged onto his face while he was lying on the ground.
