Our client (along with a passenger) were traveling northbound on Texas FM 715 early one morning. The defendant was traveling eastbound on County Road 120 in a 2022 Ford F-450 with three passengers in the vehicle. A tow truck, towing another vehicle was stopped at the intersection. As the client approached the intersection of FM 715 and CR 120, the defendant also approached but failed to stop at the stop sign and collided with the client’s vehicle on the passenger side. Upon impact, the defendant’s vehicle was pushed into the tow truck and the towed car. The client’s vehicle spun clockwise, and the rear driver-side portion of the client’s vehicle then collided with the rear of the defendant’s vehicle.
The defendant stated that he was falling asleep at the time of the incident.
