The Defendant was traveling southbound on FM 181 and came to a stop at the stop-controlled intersection of FM 181 and SH 115. The Plaintiff was traveling northbound on FM 181 and was stopped on the opposite side of the same intersection. Unit 5 was traveling eastbound on SH 115. The Defendant failed to yield the right of way at the intersection and proceeded southbound on FM 181, crossing SH 115. Unit 5 attempted to take evasive action to avoid a collision with the Defendant but struck the trailer being towed by the Defendant’s vehicle.
The impact caused the trailer to spin to the left and strike the Plaintiff’s vehicle, which was stopped at the stop sign.
