On or about March 30th at approximately 3:28 a.m., Defendant was traveling westbound on IH-30 near St. Francis in a 2017 white Volvo while hauling a 2007 white Utility trailer. Defendant failed to control his speed and lost control of the vehicle, striking a light pole with such force that the pole broke in half. The downed electrical wires fell across the highway. The fallen wires became entangled with a 2022 white Peterbilt tractor-trailer. He drove over the electrical cables, which became wrapped around the undercarriage, disabling his 18-wheeler.
Plaintiff was traveling on the RL Thornton Freeway in a 2012 red Kenworth tractor-trailer hauling a 1996 silver Travis trailer when he encountered the dangling electrical cables stretched across both the eastbound and westbound lanes. As a result of the incident, Plaintiff sustained personal injuries and his vehicle incurred property damage.
