On or about July 30, 2019, Plaintiff was working at Fun For All Park, located in College Station, Texas 77840, on a new park construction project. Plaintiff was employed by MN General Contractors LLC, working under Defendant, and was paid in cash. At the time of the incident, Plaintiff and his crew were installing canvases and shade structures. They were instructed by CTR GC (Catrock), a third party, not to use a scissor lift because it would damage the newly installed playground tile.
In order to perform their job duties, MN General Contractors typically used a boom lift; however, due to significant pressure to complete the work before the park’s inauguration deadline, they were required to use a ladder provided by their employer instead.
Our client was positioned at the top of the ladder, approximately fourteen feet above the ground, working alongside his coworker when a strap suddenly snapped. As a result, our client lost his balance and fell onto the playground surface below, landing in a standing position with the full force of the fall impacting his right leg.
