On December 16, 2024, at approximately 7:00 a.m., plaintiff was working for his brother, Mata Deliveries LLC, a subcontractor of Riverstone Logistics, in Mesquite, Texas. The company performs appliance deliveries and installations from the Lowe’s warehouse distribution center in Denton, Texas to various destinations throughout the DFW area.

After loading his box truck with appliances and preparing to depart, plaintiff walked across the warehouse parking lot, approximately 60 to 80 yards wide, to retrieve his lunch bag from his personal pickup truck. As he approached the opposite side of the parking lot, plaintiff was struck by the defendant driver, a delivery subcontractor operating as Mkatte Delivery Services LLC, who was driving a 2024 Hino 258 box truck at an unsafe speed within the distribution center parking lot.
